Minors Strict Exclusion Policy
SeekhoBecho.com operates exclusively for adults aged 18 and above. This Policy sets out the absolute prohibition on minor access, the multi-layer age verification mechanism, actions taken upon detection of a minor account, and the Company's POCSO, DPDP Act, and PROG Act compliance framework.
Purpose, Legal Basis and Absolute Prohibition
This Policy is published pursuant to the following statutory and regulatory obligations:
| Law | Provision | Relevance |
|---|---|---|
| Indian Contract Act, 1872 | Section 11 — capacity to contract; Section 10 — minor contracts are void ab initio | All subscription agreements, plan agreements, and Terms accepted by a minor are void at law and create no enforceable rights |
| PROG Act, 2025 | Section 12(3) — mandatory player protection standards including age verification for Online Social Games | Requires platforms to enforce 18+ age restriction on all gamification features |
| DPDP Act, 2023 | Section 9 — special protection for personal data of children; verifiable parental consent required before processing children's data | Prohibits Platform from processing personal data of anyone under 18 without verifiable parental consent — which the Platform does not seek or obtain, necessitating absolute exclusion |
| POCSO Act, 2012 + IT Rules, 2021 | Section 2(d) — defines child as person below 18; IT Rules 2021 Rule 3(2)(b) — intermediary obligations regarding child safety | Platform must not expose minors to any content or interaction that could harm them |
| Consumer Protection Act, 2019 | Section 2(7) — consumer means person who buys for personal use | Minor cannot be a valid consumer/subscriber under consumer protection law |
| IT Act, 2000 | Section 10A — electronic contracts; age of majority condition for valid electronic acceptance | Minor's electronic acceptance of Terms is legally void |
Legal Framework — Why 18+ is Mandatory
The 18+ restriction arises from a convergence of multiple independent legal requirements, each of which independently mandates the exclusion of minors:
| Legal Ground | Explanation |
|---|---|
| Contractual capacity (Indian Contract Act, 1872) | A contract entered into by a person under 18 is void ab initio under Section 11 read with Section 10 of the Indian Contract Act, 1872. The Kokilaben Ambani case and subsequent jurisprudence confirm that a minor cannot ratify a contract upon attaining majority. All subscription agreements, plan agreements, and Terms accepted by a minor are legally void and unenforceable — against both the minor and the Company. |
| PROG Act, 2025 — Age Verification Mandate | Section 12(3) of the PROG Act mandates that Online Social Game platforms must implement age verification mechanisms to prevent access by persons under 18. Non-compliance exposes the Company to regulatory action by OGAI. The Platform's multi-layer KYC-based age verification is designed to satisfy this mandatory PROG Act requirement. |
| DPDP Act, 2023 — Children's Data Protection | Section 9 of the DPDP Act imposes a categorical prohibition on processing personal data of children (defined as persons under 18) without verifiable parental consent. The Platform does not seek or process parental consent for minor accounts. Accordingly, no minor account may be maintained on the Platform — any minor account that comes to the Company's attention triggers mandatory data deletion obligations under Section 9. |
| Prize Claiming Requires Legal Capacity | Prize claims above ₹10,000 require PAN verification and TDS compliance under Section 194B of the Income Tax Act. A minor cannot independently hold a PAN for prize claims, cannot enter into tax-binding transactions, and cannot legally execute the KYC documentation required for prize receipt. This makes minor prize claims legally impossible. |
| Financial Transactions — Minor Protection | Pearl Recharge involves real monetary payments. A minor cannot independently enter into valid payment contracts. Bank accounts held by minors (jointly with guardians) are subject to guardian oversight and cannot be used for independent commercial subscriptions. |
| POCSO Act, 2012 — Child Safety | The Platform's operations — marketplace selling tools, gamification, competitive challenges — are not designed for, and could be harmful to, persons under 18 who lack the commercial judgment and legal capacity to engage safely with these features. |
Multi-Layer Age Verification Mechanism
The Platform employs the following multi-layer verification architecture to enforce the 18+ restriction at every access point:
| Layer | Mechanism | When Applied | Bypass Possible? |
|---|---|---|---|
| Layer 1 — Self-Declaration | Subscriber confirms 18+ at account creation via explicit checkbox and OTP-verified registration. False declaration constitutes fraud. | Account creation / registration | Self-declaration can be falsified — hence Layers 2–5 |
| Layer 2 — OTP Mobile Verification | Mobile number OTP verification required. Mobile SIM registration requires 18+ per TRAI regulations (SIM issued to adult holder). | Account creation and every login | Mobile sharing between adults and minors is possible — hence Layers 3–5 |
| Layer 3 — PAN Verification (KYC) | PAN card mandatory for subscription activation and all prize claims above ₹10,000. PAN is issued only to persons who have attained 18 or who are minors with a guardian PAN (which has different format). Guardian PAN triggers additional scrutiny. | KYC at plan activation; prize claims | PAN is the strongest age gate — a minor's own PAN cannot be substituted for an adult PAN without fraud |
| Layer 4 — Aadhaar Date of Birth Verification | Aadhaar-linked date of birth is verified through KYC partner (Digio / HyperVerge) via UIDAI. DOB is verified cryptographically. | KYC verification (Aadhaar-based) | Cannot be falsified — UIDAI verification is real-time and cryptographic |
| Layer 5 — Bank Account Verification | Active bank account required for subscription. Indian banks require 18+ for independent operation of savings/current accounts. Minor accounts require guardian joint operation. | KYC — bank account verification | Guardian joint accounts are monitored for age mismatches |
| Layer 6 — Behavioural Monitoring | Usage patterns inconsistent with adult commercial activity (login during school hours, zero commercial engagement, device sharing with known minor devices) are flagged for review. | Continuous — post-activation | Not a gate — a detection mechanism |
Features Technically Blocked for Minors
The following features are subject to technical access controls that prevent activation for any account whose age cannot be confirmed as 18+:
| Feature Category | Features Blocked | Technical Mechanism |
|---|---|---|
| Subscription Activation | All 7 subscription plans (Silver, Gold, Titanium, Elite, Platinum, Platinum Plus, Diamond) and all L1–L6 recharge plans | KYC gate — plan activation blocked until adult age confirmed via PAN + Aadhaar |
| Pearl Economy | Pearl Wallet creation, Pearl Recharge, all Pearl earn triggers, Pearl redemption, Pearl Recharge payment | Wallet creation blocked; Recharge payment gateway blocked for unverified accounts |
| Gamification | Roz Ka Inaam entries, Lucky Hour, 1v1 Skill Challenges, Grand Tambola, Maha Jackpot, Vyapar Sprint, Weekly Tournament, Selling League | Gamification module locked behind KYC verification |
| Prize Claims | All prize claims — physical prizes, Pearl rewards, vouchers, cash prizes from Maha Jackpot / Selling League | PAN mandatory for prize KYC — minor cannot pass PAN verification independently |
| Course Access | All subscription-gated courses (WhatsApp Mastery, FB+IG Mastery, Amazon USA Mastery, Website Mastery) | Course access unlocks only post plan activation, which requires adult KYC |
| Marketplace Tools | Product catalogue downloads, marketplace listing tools, agent support, bundle activation | Locked behind plan activation gate |
| Community Features | Clan creation, Selling League participation, Leaderboard ranking | Locked behind active subscription |
Detection of Minor Account — Immediate Actions
Upon discovery — whether through routine KYC review, fraud detection algorithms, third-party report, or any other means — that an account has been or is being operated by a person under the age of 18, the Company shall take the following actions immediately and without prior notice:
- Account Suspension (Immediate): The account is suspended pending investigation. All features become inaccessible to the account holder.
- Service Termination: All subscription services, gamification access, and Pearl Economy features are permanently terminated. No refund is payable.
- Pearl Balance Forfeiture (Permanent): All Pearl balances in all wallets — regardless of source (earned, recharged, referral, or prize credits) — are permanently and irrevocably forfeited. No restoration under any circumstance.
- Prize Forfeiture (Permanent): Any unclaimed, pending, or in-transit prizes are permanently forfeited. Any prizes already delivered cannot be recalled but constitute unlawful receipt by a minor — legal responsibility rests with the parent/guardian.
- Subscription Termination Without Refund: The subscription is terminated without refund of any amount, including subscription fees, Pearl Recharge amounts, or add-on fees. No pro-rated refund is available.
- Data Deletion (DPDP Act 2023, Section 9): All personal data of the minor is deleted from the Company's systems within the timelines prescribed under Section 9 of the DPDP Act, 2023, retaining only the data required for statutory compliance purposes (fraud records, legal hold data).
- Notification (where appropriate): Where the Company has contact details for a parent or guardian, the Company may notify them of the account discovery. The Company is under no obligation to provide this notification.
- Legal Action (where fraud is evident): Where the minor's access was facilitated by fraudulent use of an adult's identity documents, PAN, or Aadhaar, the Company reserves the right to file a complaint under BNS 2023 against the facilitating adult.
Personal Data of Minors — DPDP Act 2023
Section 9 of the Digital Personal Data Protection Act, 2023 ("DPDP Act") imposes specific obligations on Data Fiduciaries when processing personal data of children (persons under 18). The Company's compliance framework for minor personal data is as follows:
| DPDP Act Obligation | Company's Compliance Action |
|---|---|
| Section 9(1) — Verifiable parental consent required before processing child's data | The Company does not process personal data of persons under 18. The multi-layer KYC verification prevents minor account creation. If a minor's data is inadvertently processed, it is deleted immediately upon discovery. |
| Section 9(2) — Prohibition on processing child's data detrimental to wellbeing | The Platform does not direct any content, gamification, or commerce feature at persons under 18. No targeted advertising or behavioural profiling of minors is conducted. |
| Section 9(3) — Prohibition on tracking or monitoring children | No tracking, profiling, or behavioural monitoring is applied to any account identified as belonging to a minor. |
| Data deletion upon discovery | All personal data of the minor — registration details, PAN (masked), Aadhaar reference, usage logs, Pearl transaction records — is deleted upon account termination, retaining only the minimum required for legal hold and fraud prevention records. |
The Company's obligations under Section 9 of the DPDP Act reinforce the practical necessity of the 18+ absolute exclusion policy. Processing a minor's data without verifiable parental consent is a violation of the DPDP Act, exposing the Company to regulatory action by the Data Protection Board of India. The absolute 18+ restriction is therefore both a legal compliance measure and a child safety imperative.
Parental and Guardian Obligations
Parents and guardians of persons under 18 bear the following obligations in connection with the SeekhoBecho Platform:
- Supervise device access: Ensure that minors under their care do not access devices on which an adult's SeekhoBecho account is active, or attempt to use an adult's credentials to register;
- Protect identity documents: Never share PAN cards, Aadhaar cards, bank account details, or OTPs with minors. These documents can be misused to create accounts on age-restricted platforms;
- Report minor accounts: If a parent or guardian becomes aware that a minor has created a SeekhoBecho account using their own or borrowed identity documents, they should report it immediately to grievance@seekhobecho.com with subject line "Minor Account Report — Urgent";
- Supervise digital spending: If a minor has access to a parent's payment methods, supervise online transactions. Unauthorised Pearl Recharge by a minor using a parent's payment method is not refundable.

Platform Design Commitment — No Minor-Targeted Content
The Company commits to the following design principles to ensure the Platform remains adult-oriented and does not inadvertently attract minor users:
- No minor-targeted gamification: Game designs, prize structures, and engagement mechanics are designed for adult commercial participants — not children. No feature uses characters, themes, or mechanics designed to appeal specifically to persons under 18;
- SeekhoBecho Doll — Adult Promotional Context: Pearl Fairy and Celestial Prince (the SeekhoBecho Doll mascots) are brand ambassadors for an adult commerce platform. Their physical toy manifestation is a promotional prize — not a children's toy product marketed to minors;
- No income promises to minors: The Platform's marketing does not target or appeal to school students, college students below 18, or any minor demographic;
- Content moderation: User-generated content within community features is moderated for appropriateness. Content that could harm minors or that is directed at minors is removed;
- POCSO Act compliance: The Company maintains full compliance with the Protection of Children from Sexual Offences Act, 2012, the IT Rules, 2021, and the DPDP Act, 2023 on child safety. Any CSAM or child-harmful content detected on the Platform is reported to law enforcement and NCMEC immediately.
